Terms of Service

By accessing or using Banana Studio (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use this Service. By using the Service, you represent that you meet this requirement.

Banana Studio is an independent, third-party web application that provides AI-powered text-to-image generation. The Service utilizes third-party AI models and APIs to generate images based on user-provided text prompts. Banana Studio is powered by Google Nano Banana model.

Important: Banana Studio is not affiliated with, endorsed by, or sponsored by Google, Alphabet Inc., or the official model owner. Google and Nano Banana are trademarks of their respective owners.

The Service is provided on an “as available” basis. We do not guarantee uninterrupted access, specific generation quality, or compatibility with all use cases.

You may use limited features of the Service without an account. To access additional features and higher usage limits, you must create an account and may purchase a subscription.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Subscriptions: Paid subscriptions are billed on a recurring basis (monthly or annually, as selected). You may cancel your subscription at any time; cancellation will take effect at the end of the current billing period.

Refunds: All payments are non-refundable unless required by applicable law. We do not provide refunds for partial subscription periods, unused credits, or dissatisfaction with generated results.

The Service operates with usage limits based on your subscription tier. These limits include, but are not limited to, the number of image generations per period and access to specific generation modes.

Fair Use: The Service is intended for personal and reasonable commercial use. Automated access, bulk generation via scripts, API abuse, or any activity that places excessive load on our infrastructure is prohibited.

Rate Limiting: We implement rate limiting to ensure fair access for all users. Repeated violations may result in temporary or permanent suspension of your account.

We reserve the right to modify usage limits at any time. Significant changes will be communicated to active subscribers in advance.

You agree not to use the Service to generate, request, or distribute:

• Content that is illegal under applicable law, including but not limited to content depicting child sexual abuse material (CSAM)
• Content that infringes on intellectual property rights, including copyrights, trademarks, or rights of publicity
• Content intended to harass, threaten, defame, or harm individuals or groups
• Deepfakes or non-consensual intimate imagery of real individuals
• Content designed to spread misinformation or deceive others
• Malware, spam, or content facilitating fraud or phishing

We reserve the right to review generated content for compliance, suspend accounts that violate these policies, and report illegal activity to appropriate authorities.

Ownership: Subject to the underlying AI model providers' terms, you retain rights to the images you generate using the Service, provided your use complies with these Terms and applicable law.

No Guarantees: AI-generated content is inherently unpredictable. We do not guarantee that generated images will meet your expectations, be free of artifacts, or be suitable for any particular purpose.

Your Responsibility: You are solely responsible for how you use generated images, including ensuring compliance with applicable laws, third-party rights, and platform policies where you publish or distribute the content.

The Service relies on third-party providers for core functionality, including:

• AI model providers for image generation
• Creem for payment processing
• Authentication providers (e.g., Google OAuth)
• Cloud infrastructure and storage providers

Your use of the Service is also subject to the terms and policies of these third-party providers. We are not responsible for the actions, availability, or policies of third-party services.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied.

We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected.

To the maximum extent permitted by applicable law, Banana Studio and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you via email or through the Service.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
